tl;dr I dont believe in copyright or image rights so yeah I think anything that is released one way or another on the internet becomes public property. It's all data after all, just pixels. Technically cracky could take this site down if she wanted but I think she knows despite it being legal it wouldn't be moral because censorship is wrong.
The only thing that brings me moral doubts is printing cracky pics and putting them in public places or cd's like I've seen someone do in pictures. As long as it it keepen in the internet I think its ok.
I don't know what you refer as cracky merch tho.
